Regulations of Courses CSMI WUM

General Provisions

1.1 The organizer of the Courses is:
The Medical Simulation and Innovation Center of the Medical University of Warsaw Sp. z o.o., with its registered office in Warsaw, address: ul. Żwirki i Wigury 61, 02-091 Warsaw, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register under KRS number 0000706395, REGON: 368854493, NIP: 7010780339, with share capital in the amount of PLN 1,400,000.00 (say: one million four hundred thousand zloty), phone number: +48 22 572 03 15, e-mail address: biuro@csmiwum.pl.

1.2 The provisions of these Regulations constitute an integral part of the Course Participation Application and are binding on all Participants.

1.3 Detailed information about the Organizer’s courses, their prices and payment terms for participating in the Course are published on the website of the respective Course at the Organizer’s website: csmiwum.pl.

1.4 The courses are intended in particular for: doctors, paramedics, nurses, physiotherapists, and laboratory diagnosticians.


Participation Rules

2.1 The conditions for participating in the Course are: a) Submission of a Course Participation Application via the online form available on the Course website, by correctly filling in all required fields and submitting the form electronically to the Organizer.
b) Payment of the Course fee in the amount specified by the Organizer to the bank account provided during registration for the given Course or via electronic payments made available by the Organizer.
c) The Course fee must be paid no later than 2 months before the date of the Course, unless the Organizer sets another deadline. After this deadline, the Organizer may delete the Course application and consider it invalid.

2.2 A correctly submitted application is confirmed by a message displayed on the website immediately after completing the form, and a similar confirmation message sent to the email address provided during registration.

2.3 The message confirming correct form submission is not a confirmation of registration for the Course.

2.4 After payment is received, the Participant will receive a registration confirmation from the Organizer authorizing participation in the Course. The contract for participation in the Course is concluded upon sending of the aforementioned confirmation by the Organizer to the Participant.

2.5 The Organizer will issue an invoice for Course participation within 7 working days of receiving the payment and send it electronically to the email address provided during the registration process.

2.6 The Organizer reserves the right to deny participation in the Course if the Participant does not have the registration confirmation sent by the Organizer.

2.7 The number of Participants in the Course is limited. Participation is determined by the order of applications. Information about the lack of available spots is communicated by the Organizer via the Course website, email, or telephone.

2.8 After all available spots are filled, the Organizer will add interested individuals to a waiting list, provided they consent to data processing for future recruitment.

2.9 If a Participant is unable to attend the Course, they may designate a replacement. In this case, the Participant is obliged to inform the substitute about the Course regulations and fulfill, on behalf of the Organizer, the informational obligation attached to the regulations.

2.10 In exceptional circumstances, after prior agreement with the Organizer, it is possible to make advance payments for selected training based on a proforma invoice, which will then be credited towards the final fee.

2.11 The Participant is responsible for their own travel and accommodation expenses.

2.12 Completion of the Course by the Participant will be confirmed by a certificate of participation issued by the Organizer.

2.13 The Organizer provides protective clothing appropriate to the Course program, lunch, and snacks during coffee breaks.

2.14 The Organizer may require a knowledge test acquired during the Course, and passing the test may be a condition for receiving the certificate referred to in point 2.12.


Cancellation of Participation

3.1 The Participant may cancel their participation in the Course before it begins. Cancellation should be submitted by email to: edukacja@csmiwum.pl or in written form sent to the Organizer’s address.

3.2 In the case of cancellation, as referred to in point 3.1: a) If the Organizer receives the cancellation more than 30 days before the Course begins, the Participant will receive a refund minus a 5% cancellation fee.
b) If the cancellation is received 30 to 14 days before the Course begins, the Organizer has the right to retain 30% of the total fee.
c) If the cancellation is received 14 days or fewer before the Course begins, or if the Participant fails to inform the Organizer, the Organizer has the right to retain the full amount paid.


Organizational Changes and Course Cancellation

4.1 The Organizer reserves the right to change speakers or make program modifications due to circumstances beyond their control. In such cases, Participants are not entitled to a refund.

4.2 The Organizer reserves the right to change the date of the Course. In such cases, the Participant has the right to withdraw from the Course, and the Organizer will promptly refund the amount paid to the bank account indicated by the Participant.

4.3 If the Course is canceled for reasons attributable to the Organizer, the Participant will receive a full refund to the indicated bank account.

4.4 If the Course is canceled or rescheduled due to reasons beyond the Organizer’s control, the Organizer is not responsible for any costs incurred by the Participant related to travel or accommodation.


Participant Responsibility

5.1 Participants are fully financially responsible for any damage they cause.

5.2 The Organizer is not liable for the Participant’s belongings that may be damaged, lost, or stolen during the Course.


Complaints

6.1 Any complaints from Course Participants addressed to the Course Organizer should be submitted electronically to: edukacja@csmiwum.pl or by mail to the Organizer’s address.
6.2 Complaints may be submitted no later than 21 days after the completion of the Course.
6.3 Complaints submitted after the deadlines specified above will not be considered.


Recording of Image and Sound

7.1 Recording the Course using recording devices without the prior consent of the Organizer and the Course instructor is prohibited. Participants are also not allowed to use materials obtained from the Organizer or instructors during the Course for commercial purposes, in particular to conduct other courses, without prior written consent from both the Organizer and the instructor. The Course content and materials provided to Participants during the Course constitute works within the meaning of the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws 2019, item 1231, as amended in 2020, item 288, as later amended) and are legally protected.
7.2 The Organizer reserves the right to record the event (take photographs, record videos) for informational and promotional purposes related to the activities of CSMI WUM Sp. z o.o. If profile photos are taken, the individuals concerned will be asked to give their voluntary consent to the processing and publication of their personal data.


Final Provisions

8.1 Submitting a registration form via the Course website constitutes acceptance of the provisions of these Terms and Conditions, as well as compliance with the rules and any other arrangements made in writing or documented form between the Participant and the Organizer.
8.2 Acceptance of the Terms and Conditions is equivalent to entering into an agreement between the Organizer and the Course Participant.
8.3 If the Course involves the use of anatomical specimens, the Participant simultaneously accepts the “Regulations for Courses Using Anatomical Specimens” available on the Organizer’s website and during the Course.

8.5 Any matters not regulated by these Terms and Conditions shall be governed by the provisions of the Civil Code.
8.6 Any disputes arising from participation in the Course shall be resolved by the court having jurisdiction over the location of the course.
8.7 An integral part of the Terms and Conditions is the Information Clause for course participants.


INFORMATION CLAUSE FOR COURSE PARTICIPANTS

Source and scope of data processed
Your personal data (name, surname, PWZ number) may have been obtained from a sponsor or another entity that referred you to the course.

Purpose and legal basis for processing personal data
Your personal data will be processed solely for the purpose of:
• performing actions leading to the conclusion of an agreement or executing its provisions, in accordance with Article 6(1)(b) of the GDPR,
• fulfilling a legal obligation incumbent upon us under tax regulations and the Civil Code – document archiving, in accordance with Article 6(1)(c) of the GDPR,
• pursuing our legitimate interests, in accordance with Article 6(1)(f) of the GDPR, such as potential claims or defense against claims, ensuring the highest quality of service, communication regarding organizational matters related to the course, providing the sponsor with a list (name and surname) of trained individuals as a basis for settlement between us and the sponsor,
• sending commercial information, sharing your contact details with the sponsor, processing your data on a waiting list, or registering and publishing your image, if consent is given, in accordance with Article 6(1)(f) of the GDPR.

Data recipients
Your personal data may be shared with the event sponsor, the Tax Office, postal service providers, a law firm supporting us in the event of claims, and entities cooperating with us in connection with service provision, including:
• hosting services,
• IT solutions, software providers, IT support, and website positioning services,
• accounting office.

Data retention period
Your personal data will be processed for:
• 5 years (from the end of the year), in the case of data regulated by law, calculated from the end of cooperation, in accordance with Article 74 of the Accounting Act – for individuals who participated in the course,
• until consent is withdrawn – for data processed based on consent,
• until the limitation period for claims or until an effective objection is filed.

Your rights
In connection with the processing of your personal data, you have the right to:
• access your data,
• rectify your data,
• delete your data if it is processed without legal basis,
• transfer data where processing is based on consent or a contract,
• restrict processing,
• object to processing,
• withdraw consent at any time – withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal,
• lodge a complaint with the Data Protection Authority (UODO) if you believe that the processing of your personal data violates GDPR regulations.

Voluntary provision of data
You provide your data voluntarily. However, providing personal data is a prerequisite for participating in the course. Failure to provide the data will make it impossible to enter into the agreement.
